USER TERMS OF SERVICE

These Terms of Service (“Terms”) govern the use of assistance services offered under the brand AssistHour, operated by Insightogram Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at Indore, Madhya Pradesh (“Company”, “we”, “us”).

By booking or using any service through the AssistHour mobile application, WhatsApp, phone call, or any other booking channel, the user (“User”, “you”) agrees to be bound by these Terms.

1. NATURE OF SERVICES

1.1 AssistHour provides and facilitates on-demand assistance and support services through trusted and verified assistants available on its platform. AssistHour is a service facilitation platform operated by Insightogram (the “Company”), which connects customers (“Users”) with independent service providers (“Helpers”) for short-term, task-based assistance.

1.2 Nature of Services
AssistHour acts solely as a facilitator between Users and Helpers. We do not directly provide the services performed by Helpers. The quality, execution, and outcome of services are the sole responsibility of the Helper.

1.3 Services include non-professional support such as:

  • Hospital and clinic assistance
  • Elderly escort, walking, medicines and report pickup, and wheelchair assistance
  • Office, bank, government office visits (support only)
  • Event assistance
  • General assistance such as packing, serving, shopping, and light physical support

1.4 AssistHour does not provide medical, legal, nursing, or professional services of any kind.

2. USER RESPONSIBILITIES

2.1 The User shall provide:

  • Accurate instructions
  • Safe working conditions
  • Clear scope of work as per booking

2.2 The User shall not:

  • Ask helpers to perform illegal or unsafe tasks
  • Hand over original or important documents
  • Demand medical advice or treatment

3. PHYSICAL ASSISTANCE DISCLAIMER

3.1 Some services involve physical assistance (e.g., walking support, wheelchair assistance).

3.2 The User acknowledges that:

  • Such assistance is provided at the User’s request
  • The Company does not guarantee outcomes
  • The User assumes inherent risks associated with physical movement

4. LIMITATION OF LIABILITY (BOOKING CAP)

4.1 To the maximum extent permitted by law, the total liability of the Company arising out of or relating to any booking shall not exceed the amount paid by the User for that specific booking.

4.2 The User agrees that the service fee reflects a fair allocation of risk between the parties.

4.3 The Company shall not be liable for:

  • Indirect or consequential damages
  • Emotional distress
  • Loss of opportunity or income

5. DAMAGE & COMPLAINTS

5.1 Any damage or issue must be reported immediately.

5.2 The Company may investigate and take appropriate action.

5.3 Refunds or compensation, if any, shall be governed strictly by these Terms.

6. PAYMENTS, CANCELLATION & REFUNDS

6.1 Payments are collected exclusively by the Company.

6.2 Cancellation and refunds are governed by the Refund & Cancellation Policy.

7. TERMINATION OF SERVICE

The Company reserves the right to:

  • Refuse service
  • Suspend or cancel bookings
  • Block users for misuse or violations

8. GOVERNING LAW & JURISDICTION

These Terms shall be governed by the laws of India.
Courts at Pune, Maharashtra shall have exclusive jurisdiction.

9. ACCEPTANCE

By proceeding with booking or using AssistHour services, the User confirms that they have read, understood, and accepted these Terms.


REFUND & CANCELLATION POLICY

1. CANCELLATION BY USER

  • Before helper assignment: Full refund
  • After helper assignment: Partial or no refund (at Company discretion)

2. CANCELLATION BY COMPANY

Full refund if service cannot be delivered

3. NO-SHOW

No refund if helper arrives and user is unavailable

4. REFUND MODE

Refunds are processed to original payment method within reasonable time.

WhatsApp Booking Acceptance Text:
“By proceeding with this booking, you confirm that you have read and agree to AssistHour’s Terms of Service, Liability Waiver, Privacy Policy, and Refund Policy.”

In-App Acceptance Checkbox Text:
☑️ “I have read and agree to the Terms of Service, Liability Waiver, Privacy Policy, and Refund & Cancellation Policy.”

SMS Acceptance Checkbox Text:
“AssistHour booking confirmed. By proceeding, you accept our Privacy Policy & User Agreement and agree to receive service updates. STOP to opt out.”
